Re: Application to Reallocate General Costs - 18 February 2000
Take notice that an application has been scheduled by the 570 Dunsmuir
Lenders Committee to take place before Mr. Justice Tysoe commencing 10:00
am, Wednesday, the 8th day of March, 2000 at the Court House, 800 Smithe
Street, Vancouver, British Columbia for an Order that the Order of Mr.
Justice Tysoe pronounced January 23, 1998 be varied such that indirect
costs will no longer be allocated on the basis of the amount of direct
costs spent on any given project but on the basis of the amount of the
recoveries made from each project. Thus, if lenders are in a project
which has had a significant recovery they may find that the percentage of
indirect costs which they must pay will be increase significantly.
Pursuant to the Order of Mr. Justice Tysoe pronounced December 15, 1999
any party which wishes to file or rely upon affidavit evidence must file
that affidavit by February 25, 2000 and serve it upon David G.
Fredricksen, counsel for 570 Dunsmuir Lenders Committee at 200 - 1067
Richards Street, Vancouver, British Columbia V6B 3E5 and John Grieve,
counsel for the Judicial Trustee at 2100 - 1075 West Georgia Street,
Vancouver, British Columbia V6E 3G2.
Any party who wishes to address argument to the court must prepare a
written submission and provide them to counsel for the Judicial Trustee
and counsel for the applicant on or before March 3, 2000.
